LEAGUE TRIES TO CURB LIBRARY BOARDS

One group’s opinion. “The League of Kansas Municipalities has recently published its opinion that cities may use that authority not only to restrict library funding, but also ‘to set up the library structure in a way that works for the city from an organizational standpoint.’ This is only the opinion of the attorney of the League of Municipalities. It is not a Kansas Attorney General’s Opinion or a court ruling.

Getting prepared. “Library boards should rightfully be alarmed at this opinion that questions the authority, and even the continuing existence, of library boards. All library boards are urged to strengthen their relationships with their city governments, but also to be prepared to vigorously defend their authority, if that is called into question.” Minges concluded by urging boards to contact their regional system and the State Library if their city attempts to restrict the library board’s authority citing the August, 2003 opinion printed in the League’s magazine.

Hays’ director takes the initiative. After reading the League article, Hays’ director Melanie Miller requested a legal opinion from State Representative and attorney Mike O’Neal. She sent his response (see back cover for excerpts) to all Kansas directors. Her cover letter urged watching their city commission agendas.
